Personal Data Protection – Terms and Conditions

I. Basic Provisions

  1. The controller of personal data according to Article 4(7) of the Regulation of the European Parliament and of the Council (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter: “GDPR”) is DATRIA s.r.o., ID No.: 04261763, VAT No.: CZ04261763, with its registered office at Dašická 1185, Chrudim IV, 53701 Chrudim (hereinafter “controller”). File number: C 35506 kept at the Regional Court in Hradec Králové.

  3. Personal data means any information about an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.

  4. The controller has not appointed a Data Protection Officer.

II. Legal Basis for Processing Personal Data

  1. The legal basis for processing personal data is the performance of a contract between you and the controller according to Article 6(1)(b) GDPR. (hereinafter “Performance of Contract”) - processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.

  2. The controller does not perform automated individual decision-making according to Article 22 GDPR.

IV. Data Retention Period

  1. The controller stores personal data

    • In the case of a request, personal data contained in the form is managed only for the purpose of responding to or processing your inquiry or request /only for the duration of negotiations on entering into a contract/ for no longer than 1 year from your request, unless you consent to further processing.

    • In the case of an order, for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and for asserting claims from these contractual relationships (for a period of 15 years after the termination of the contractual relationship).

  2. After the retention period expires, the controller will delete the personal data.

V. Recipients of Personal Data (Subcontractors of the Controller)

  1. Recipients of personal data are persons:

    • Providing services for the operation of the website/e-shop (Alexandr Zlesák, DiS. - AZ Computers, ID No. 70163278) and other services related to the operation of the website/e-shop.

    • Personal data of the data subject may be provided for the purpose of proper contract performance to the provider of delivery services, and also to persons who provide legal, accounting, and IT services to the controller in the interest of ensuring the proper fulfillment of obligations stipulated by generally binding legal regulations. The controller does not intend to transfer personal data of the data subject to a third country, international organization, or other than the above-mentioned third parties.

VI. Your Rights

  1. Under the conditions set out in the GDPR, you have

    • the right of access to your personal data according to Article 15 GDPR,

    • the right to rectification of personal data according to Article 16 GDPR, or restriction of processing according to Article 18 GDPR,

    • the right to erasure of personal data according to Article 17 GDPR,

    • the right to object to processing according to Article 21 GDPR, and

    • the right to data portability according to Article 20 GDPR.

  2. Furthermore, you have the right to file a complaint with the Data Protection Authority if you believe that your right to data protection has been violated.

VII. Personal Data Security Conditions

  1. The controller declares that all appropriate technical and organizational measures have been taken to secure personal data.

  2. The controller has adopted technical measures to secure data storage and physical storage of personal data, in particular passwords, antivirus software, backup, encryption, and physical security measures.

  3. The controller declares that access to personal data is granted only to persons authorized by him.

VIII. Final Provisions

  1. By sending an order from the online order form or a request from the online inquiry form, you confirm that you are familiar with the terms of personal data protection and that you accept them in their entirety.

  2. The controller is entitled to change these conditions. A new version of the personal data protection conditions will be published on its websites.


These conditions take effect on 25.5.2018.
